"Landmark Judgment: Malawi's Constitutional Challenge on Same-Sex Relationships"
This morning, the High Court's Constitutional Court in Blantyre delivered a landmark judgment in a case challenging Malawi’s laws that criminalize same-sex relationships.
The applicants, Jan Willem Akster from the Netherlands and Jana Gonani, faced criminal charges in magistrate courts for their alleged involvement in same-sex relationships. They brought their case to the Constitutional Court seeking an interpretation of the provisions in the Penal Code and urged the Court to declare these laws unconstitutional.
Akster was accused of allegedly engaging in non-consensual relationships, including with boys, while managing a foundation in Blantyre. Meanwhile, Gonani was accused of presenting as a woman in drinking establishments to engage in relationships with other men.

Impact of MPC's Postbus Service Suspension on Malawi's Transportation Sector
The Malawi Posts Corporation has announced the indefinite suspension of its postbus service operations beginning June 30 this year due to ongoing financial losses. According to a notice issued to customers, MPC cites challenges in maintaining satisfactory service levels due to the advanced age of their fleet, necessitating frequent maintenance and resulting in escalating operational expenses.
Since its establishment in 2019, the company reports having transported more than 1.3 million passengers across routes including Blantyre, Lilongwe, Mzuzu, and Karonga. Economic analyst Christopher Mbukwa predicts potential job losses among MPC employees and broader implications for the country's economy.
Joel Jere, executive director of the Road Safety Alert Foundation (ROSAF), acknowledges the setback for the transportation sector but views the decision as timely, considering MPC's buses frequently experienced breakdowns and accidents.
